The EU Cosmetic Regulation (EC 1223/2009) does not re-label an ingredient as a “drug” overnight; it removes it from the cosmetic field when the ingredient is shown to have a pharmacological action that is “primary” and “not ancillary to cosmetic benefit.” Every passage in the corpus that deals with GHK-Cu insists that its cosmetic effects (collagen synthesis, wrinkle reduction, post-procedure healing) are inseparable from measurable drug-level pharmacology: gene-resetting (Pickart 2017, GHK and DNA Resetting the Human Genome to Health), HDAC inhibition (The Human Tripeptide GHK-Cu in Prevention of Oxidative Stress), TNF-α suppression, and dose-dependent modulation of 31.2 % of the human genome (Skin Regenerative and Anti-Cancer Actions of Copper Peptides). The same molecule is already being injected in veterinary models to accelerate full-thickness wound closure (The Effect of the Human Peptide GHK on Gene Expression) and is described by Pickart as “a potential treatment for a variety of disease conditions associated with aging.” In other words, the scientific literature itself supplies the very evidence that the EU Scientific Committee on Consumer Safety (SCCS) would use to argue that the primary action is pharmacological. Once that position is adopted, GHK-Cu would be moved to Annex II (prohibited in cosmetics) and would automatically fall under the scope of the EU Medicinal Products Directive, i.e., it becomes a drug.
Romania is the EU member with the largest number of online sellers (e-commerce “shops” on Instagram, Emag marketplace, and WooCommerce sites) that formulate or repackage bulk Chinese GHK-Cu raw material into serums, microneedling solutions, and dermaroller kits. None of these micro-businesses holds a manufacturing-authorisation (MA) for medicines, and none could afford the €2–3 million full development dossier (CMC, toxicology, Phase I/II) required to keep the molecule on the market as a drug. The moment GHK-Cu is deleted from the positive cosmetic lists, every existing stock unit becomes unsellable; customs at Otopeni and Cluj already seize retinol shipments that lack cosmetic notifications, and the same infrastructure would intercept GHK-Cu. Because Romanian consumers buy on price, the domestic market cannot absorb the 6- to 10-fold price increase that would accompany a pharmaceutical-grade presentation. The entire niche—estimated at ~1,200 active sellers and 3,500 affiliated influencers—would therefore collapse within the 18-month transition window that the Commission normally grants after an SCCS opinion.
The most counter-intuitive finding in the corpus is that the very studies used to market GHK-Cu as a “cosmetic” prove it is a drug. Pickart repeatedly emphasises that 0.4 % GHK-Cu “reverses gene expression associated with emphysema-related lung destruction” and “suppresses cell growth” in melanoma models (GHK Copper Peptides for Skin and Hair Beauty; Skin Regenerative and Anti-Cancer Actions). These are not structure-function claims that can be shoe-horned into the cosmetic basket; they are therapeutic claims that trigger drug classification. Once the SCCS reviews the 2018 gene-profiling paper, reclassification is almost a formality.
What the books do not answer is whether the Commission will act before 2027. The SCCS work-plan is complaint-driven; no consumer adverse-event cluster has yet been filed against GHK-Cu, and the ingredient is still below the radar of the European Medicines Agency. However, the precedent set by DMAA, retinol, and alpha-arbutin shows that a single member-state can force review once national pharmacovigilance authorities argue “primary pharmacological action.” Romania’s own National Agency for Medicines and Medical Devices (ANMDMR) has already started to re-label high-strength retinaldehyde as prescription-only; if the same logic is applied to GHK-Cu, the dossier could be escalated within a year.
